Terms of Service

Effective June 3, 2026

These Terms of Service ("Terms") govern your use of soothdigital.comand any services provided by Sooth Digital ("we," "us," or "our"), a U.S. small-business marketing service. By using the site or purchasing a service, you agree to these Terms.

1. Services

We offer website design, SEO content, landing pages, lead-capture, email campaigns, and related digital marketing services described on our Work page. Specific deliverables, timelines, and inclusions are defined in the package selected or in a separate written engagement.

2. Client Responsibilities

  • Providing brand assets (logo, colors), domain and hosting access where needed, and any required content within agreed timelines.
  • Reviewing drafts and providing feedback within the revision windows defined in your package.
  • Ensuring all content you supply is accurate, lawful, and that you own or have rights to use it.

Delays in providing assets, content, or feedback may extend the project timeline.

3. Payment

Prices are listed on the Work page and stated in U.S. dollars. Payments are processed securely through Stripe. One-time fees are billed at the start of an engagement. Monthly subscription packages are billed in advance and renew automatically until canceled.

4. Refund Policy

One-time services (e.g., Institution Opportunity). You may request a full refund within 7 days of purchase if work has not yet begun. Once work has started, refunds are issued on a pro-rated basis for work not yet performed, at our reasonable discretion.

Monthly subscriptions (Growth, Advancement, and similar). You may cancel at any time. Cancellation stops future billing; the current billing period is non-refundable since work and deliverables for that month are typically already in progress. To cancel, email soothdigital@riseup.net at least 3 days before your next renewal date.

Chargebacks. Please contact us first to resolve any billing concern before initiating a chargeback.

5. Intellectual Property

Upon full payment, you own the final deliverables we create for you (website content, copy, designs). We retain the right to use non-confidential portions of the work in our portfolio and case studies. We retain ownership of any underlying tools, templates, and methodologies we develop.

6. Third-Party Services

Projects may involve third-party platforms (domain registrars, hosting, email providers, analytics, payment processors). Their terms and pricing apply separately and are not under our control.

7. Confidentiality

We will treat non-public information you share with us as confidential and use it only to deliver services to you.

8. Warranties and Disclaimers

We perform our services with professional care. However, marketing results (rankings, traffic, leads, conversions, revenue) depend on many factors outside our control. We do not guarantee specific business outcomes. The site and services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the services or these Terms will not exceed the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.

10. Termination

Either party may terminate an engagement with written notice. You remain responsible for fees for work completed up to the termination date.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which Sooth Digital is principally located, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in that jurisdiction.

12. Changes

We may update these Terms from time to time. Continued use of the site or services after changes take effect constitutes acceptance.
